Overview

Can You Extend a Villa in a Nakheel Community?

Yes. Nakheel accepts Non-Standard applications for villa extensions on a case-by-case basis. This includes adding rooms, increasing Built-Up Area (BUA), and enclosing balconies. However, you must follow the official DCUP approval process before starting any work.

What IS Allowed

Adding rooms and increasing BUA (Non-Standard application, case-by-case). Enclosing balconies. Enclosing terraces and double-height voids. Swimming pools in rear/side garden. Pergolas up to 20sqm. Landscaping modifications.

What is NOT Allowed

Property subdivision for separate letting. Non-residential uses. Development beyond plot boundary. External staircases. Swimming pools on townhouses or canal homes. Changes to roof height or materials. New windows facing neighbours.

Community-Specific Rules

JVT/JVC: Adding extra plot area NOT allowed, but adding rooms, BUA, and enclosing balconies IS allowed. Palm Jumeirah and Jumeirah Islands: Can purchase additional plot area (extended plots). Each community has different fees.

Approval Process

The 3-Stage Nakheel Approval Process

Every villa extension must go through these 3 stages. Skipping any stage risks fines, demolition orders, and Trakhees enforcement action.

Provisional Approval

Pre-application meeting with DCUP. Site visit to confirm no existing unauthorized works. Submit architectural drawings with area calculations. Pay review fee (AED 2,500-5,000). Valid for 6 months.

Nakheel NOC

Obtain NOCs from DEWA, Lootah Gas, and du. Get neighbour NOC if extension impacts adjacent property. Pay BUA fees per square foot. Submit detailed drawings. NOC valid for 6 months to apply for Trakhees Building Permit.

Build & Certify

Obtain Trakhees Building Permit. Complete construction per approved plans. Request Nakheel Compliance Certificate (NCC). Then obtain Trakhees Building Completion Certificate (BCC). Extended areas can only be used after BCC.

Technical Rules

Extension Technical Requirements

Must Attach to Villa

Extensions must be attached/annexed to the villa, not built as separate standalone structures. The extension must replicate the existing architectural styling, materials and finishes.

Maintain Setbacks

Existing critical setbacks must be maintained. Minimum 1 metre from boundary walls for swimming pools. Pergolas must keep 1m setback from property boundaries.

Match Architecture

Extensions must match the existing villa design — same materials, colours, window styles, and finishes. Changes must appear as though part of the original design intent.

Neighbour Impact

Extensions must not impact neighbours unreasonably — no blocking views, light, or privacy. If your extension affects adjacent properties, you need a No Objection letter from the neighbour.

DEWA Approval

Your proposed and existing AC and electrical load must be approved by DEWA before Nakheel issues the NOC. This is especially important for extensions adding new rooms.

30% Soft Landscape

Minimum 30% of the plot area (excluding the building) must remain as soft landscaping. Swimming pools count as hard landscaping. Every submission must show before and after percentages.

Swimming Pools

Pool Rules in Nakheel Communities

  • Pools must be in the rear and/or side garden only
  • Minimum 1 metre setback from all boundary walls
  • Must not impact structural integrity of the property
  • Pool surround must use non-slippery, durable exterior paving
  • Pool edge flush with adjacent paving or 5cm above soft landscape
  • Child-resistant access prevention systems required
  • Plant equipment must be underground with recessed manhole covers
  • No pools on townhouse or canal home plots
  • Pergolas near pools max 20sqm (15sqm for townhouses)

Stage 1: Provisional Approval

  • Pre-Application Submission Form
  • Owner passport copy and Title Deed
  • Sale and Purchase Agreement + Plot Affection Plan
  • Signed Nakheel Guidelines with initials on each page
  • Mortgage NOC (if applicable)
  • Landlord NOC (if tenant)
  • Consultant/contractor appointment letter and trade licence
  • Scaled plans showing existing and proposed layouts
  • Area calculations — hatched in yellow, outlined in red
  • Minimum 6 property photographs from different angles
  • CAD soft copy of all drawings
  • Payment receipt for DCUP review fees

Stage 2: Nakheel NOC

  • Standard Submission Form
  • DEWA No Objection Certificate
  • Lootah Gas No Objection Certificate
  • du No Objection Certificate
  • District cooling provider NOC (if applicable)
  • Electrical and AC load schedule (existing + proposed)
  • Neighbour NOC (if extension impacts them)
  • Detailed scaled plans, elevations (A3 hard + CAD soft)
  • Payment receipt for BUA fees
Unauthorized Works

What Happens If You Build Without Approval?

Building without Nakheel approval carries serious consequences. Do not start any work until you have both Nakheel NOC and Trakhees Building Permit.

Fines & Penalties

Nakheel charges AED 10,000+ in fines for unauthorized modifications plus the full BUA fees retroactively. Trakhees may impose additional fines, revoke licences, or withdraw utility services.

Demolition Orders

If unauthorized works are refused retrospectively by the Development Review Board, you must demolish the structure and restore the property to its original condition at your own cost.

Resale Problems

When you sell, Nakheel inspects the property. Unauthorized modifications block the sale until resolved. Outstanding compliance matters prevent Nakheel from issuing the transfer NOC.

Insurance & Warranty Void

Unauthorized works void your Defects Liability Period warranty. Private property insurance may also have default clauses for unapproved modifications. Your mortgage provider may also object.
